Eva Joly defends Iceland banking arrests

jolyEva Joly, adviser to Iceland’s Special Prosecutor for the banking crisis, believes the investigation can be completed within four years, if the office is provided with 80 staff members. With a smaller team, the investigation will take longer, she told RUV.

Joly said she is happy with the progress of the investigation so far and answered critics’ questions about the legality of the recent arrests robustly.

Eva Joly said that the arrests and interrogations over recent days came at the correct time. Critics’ claims that the actions were only taken to appease public demands for action do not stand up to scrutiny, she said.

The two sides in the argument have different privileges because those under investigation can talk freely with the media and present their cases, but the Special Prosecutor needs to remain quiet so as not to reveal important evidence that will be needed in court. The public must just continue to show patience and have faith that everything will be made public at the first opportunity, but not before cases go to trial.

She criticised the opinion of Sigurdur Einarsson, the former chairman of Kaupthing, saying that if he really has nothing to hide then he has no need to fear the investigation.

Joly said that the investigations could take as little as four years to complete with 80 staff. 30 people currently work for the Special Prosecutor.

    I do not aggree with her avowed politics ( Left – Green as she is a French MEP ) but I do have respect for her professional knowledge and way she has been handling advisor to Icelandic government.

    In other story she has said :

    “We had to start somewhere and Kaupthing was the biggest bank,”

    “What I’m saying is that everything will be investigated,” she said.

    “It would be unacceptable if lack of human resources would only lead to a investigation of one bank … More cases will follow suit,” she added.

    I think that it depends on the fair ness of prosecutor but more the judges.

    But lets ask the question. What would be best ?

    1. Coming voluntarily then being arrested ?

    Or

    2. having arrest warrant issued which is plastered all over international press, with unflattering photo and category of that warraent plastered all over press articles “counterfeiting, forgery and fraud ” even if actual arrest warrent only picks on one those ?

    All I have seen in press so far indicate that Ólafur Þór has been fair in dealing with those accussed including telling what will happen.

    So simply all Sigurður Einarsson done is to delay his questioning.

    I would not like this to be seen as excuse to sign Iceland up to the EU treaties on this which will allow Icelandic people to be extradited on arrest warrent from any country in EU without proof being given to Icelandic court ie the horrible ” European Arrest Warrant “.

    It will be very interestin to see what his barrister Ian Burton http://www.burtoncopeland.co.uk/lawyer.php?id=1 does come up with.

    I do wonder what new facts we will see in public domain about Kaupthign Singer and Friedlander take down by Brown and Darling as part of this.
