No criminal charges for photographing naked sleeping teen

gavel2In the southern Swedish city of Halmstad, a local court has ruled that the case of a man who photographed a naked 17-year-old woman’s genitals while she lay sleeping was not considered a punishable offence and has dismissed the charges.

The incident occurred at a party on New Year’s Eve hosted by the offender’s son where the teenage girl had lain on a sofa to sleep. The man, aged 49, allegedly lifted up the 17-year-old’s skirt and proceeded to photograph her genitalia. He was indicted by authorities on charges of sexual harassment, reports the Local.

In handing down the ruling, the district court of Halmstad cited several similar cases in support of the decision that no crime had been committed by the man. In Sweden there is no legislation that stipulates against taking photos or people without their consent, which applies also to those who are sleeping.

The court referred to a case of a man who had been indicted for charges of filming sexual intercourse with a woman without her consent which was thrown out by the Swedish Supreme Court. The court also ruled that prosecution arguments that the photograph had been shown to numerous other people did not make the offence punishable either.
